FSSAI - Food Safety

FSSAI - Food Safety and Standard Authority of India is an autonomous body that is established under the Ministry of Health and Welfare, Government of India. FSSAI License is responsible for protecting and promoting public health through the regulation.
FSSAI License/ Registration in India is mandatory for all food and food-related businesses, this 14 digit License number gives us information about the permit of the producer.
Basic License- Basic License is necessary if the annual turnover is less than Rs.12 lakh.
State License- State License should be obtained when the annual turnover is between 12-20 crores. In case of repacking, relabelling business irrespective of the turnover the business should obtain a State license.
Central License- If the annual turnover is above 20 crores then the food business must apply for a Central license. Based on the annual turnover a food business operator has to get the FSSAI License. Hence, one should obtain FSSAI License before commencing with the business as there are certain penalties and legal charges as the FSSAI rules have become stringent.

Who FBO requires basic registration?

The following require basic FSSAI registration:

Any FBO or dhaba or footstall which has turnover of lesser than 12 lakhs per annum.

Petty Food Stalls.

Cottage Industries.

Vegetable Units.

Milk producing units- This would be equivalent to about 2.5 metric tons of milk based solids. Hence FSSAI registration is required for such units. Any milk outlet producing more than 500 litres of milk.

The slaughter house must have the capacity of least 2 large animals or 50 poultry birds. This would be applicable for a slaughter house which has 10 small animals also.

Which FBO requires State registration?

Any FBO with an annual turnover of more than 12 lakhs and less than 20 crores.

Branded Food Products and Businesses.

4 Star Hotels and Resorts.

Storage Houses having a Capacity of 50,000 metric tonnes. This must be measured on annual basis.

Dairy Units that handle, process or procure milk products between 500 to 50000 litres capacity.

Slaughter House – 50 Large animals or 150 small animals of 1000 poultry birds.

Which FBO requires Central Registration?

Any FBO with an annual turnover of more than 20 crores.

Production of any form of vegetable oil or solvent which exceeds the capacity of 2 metric tonnes per day. This would include solvent extraction and refineries.

Clubs, Hotels or Resorts with branches more than one state.

5 star hotels and resorts

Whole Salers whose annual turnover exceeds 30 crores.

Airports, Railways, Defence and Other Services which are provided by the Central Government.

Dairy Units producing or handling milk more than 50,000 litres per day.

Slaughter House – More than50 Large animals or 150 small animals of 1000 poultry birds.

Storage Houses having more than 50,000 metric tonnes of capacity. This must be measured on annual basis.


Procedure for Obtaining FSSAI Registration Online

  • FBOs can obtain FSSAI registration online by filling and submitting the FSSAI registration form, i.e. Form A (application for Registration) or Form B (application for State and Central License) on the FoSCoS portal. The FBOs can also register offline by submitting Form A or Form B to the Food and Safety Department.
  • The FSSAI registration form must be accompanied by the required documents. The documents must be uploaded online on the FoSCos portal at the time of filling the application or submitted to the Food and Safety Department along with the application physically.
  • The FSSAI registration form can be accepted or it may be rejected by the Department within 7 days from the date of receipt of an application either physically or online through the FoSCoS portal. If the application is rejected it has to be intimated to the applicant in writing.
  • The Department will scrutinise the documents submitted.
  • The Department may conduct an inspection of the food premises, before granting the FSSAI registration certificate, if necessary.
  • If the Department is satisfied that the FBO meets all the required criteria, then it will grant an FSSAI registration certificate with the registration number and the photo of the applicant email ID. The applicant can also download the FSSAI registration certificate by logging into the FoSCoS portal.
  • FBO should prominently display the certificate of FSSAI registration at the place of business during business hours.

FSSAI: FAQ

Ans: Responsibility of ensuring compliance of FSS Act, 2006 rules and regulations made thereunder by the FBO’s

Ans:Enforcement is undertaken on the basis of surveillance, monitoring, inspection and random sampling of food products carried out by the Officials of Food Safety Departments

Ans:The enforcement is primarily undertaken by all Food Safety Commissioners of State/UT along with Designated Officers and Food Safety Officers.

Ans: The FSO shall be liable to a penalty which may extend up to one lakh rupee ifhe / she is found to be guilty of an offence mentioned under section 39 of the Act. Provided that in case the complaint made against the Food Safety Officer is false, the complainant shall be punishable with fine which shall not be less than fifty thousand rupees and may extend to one lakh rupees.

Ans: The improvement notice is the notice issued by Designated Officer if FBO fails to comply with the regulations as mentioned in Section 32 of the FSS Act, 2006.

Ans:- If the food business operator fails to comply with an improvement notice, his licence may be suspended.

Ans:- If the food business operator fails to comply with the improvement notice, the DO may, after giving the licensee an opportunity to show cause, cancel the licence.

Ans:- Yes, any FBO aggrieved by an improvement notice may appeal to the State Commissioner of Food Safety whose decision thereon shall be final. The same can be challenged in the Food safety Appellate Tribunal/ high court of his respective States/Uts

Ans:-Fifteen days from the date on which notice of the decision was served on the person desiring to appeal or the period specified in the improvement notice whichever expires earlier.
